GEORGE’S DELI COMPETITION TERMS AND CONDITIONS

This document sets out the terms and conditions that govern the draw to win a George’s Deli Kingscliff, Food and Drink Voucher (the Competition) run by Alice Coote trading as Alice & Co Media and Communications (ABN 74 019 034 865) (Alice & Co). By submitting an entry for the Competition, you agree to be bound to these terms and conditions.

1 APPLICABILITY
Information on how to enter and prizes form part of these conditions. Entries must comply with these conditions to be valid.

2 COMPETITION PERIOD
The Competition will commence on 8 November 2024 (Commencement Date) at 8:30AM AEDT and end on 15 December 2024 (End Date) at 5:00PM AEDT (Competition Period).

3 ELIGIBLE ENTRANTS
(a) Entry is open to any person that is residing in Australia who agree to Alice & Co’s terms and conditions and privacy policy located here: Terms and Conditions AND Privacy Policy.
(b) Each person who complies with clause 3(a) above will be an ‘Eligible Entrant’ for the purposes of these terms and conditions (Eligible Entrant).
(c) The maximum number of entries per Eligible Entrant for the duration of the Competition is one (1).

4 COSTS
The Competition requires no purchase or payment to enter. Eligible Entrants are responsible for all expenses to submit an entry.

5 SUBMITTING AN ENTRY
(a) To enter the Competition, Eligible Entrants must:
(i) Follow the George’s Deli Kingscliff Instragram page “@georges.kingscliff”
(ii) Follow the Coastal Buys Magazine Instagram page “@coastal_buys”;
(iii)Follow the Coastal Buys Australia Instagram page “@coastalbuysaustralia”;
(iv) Tag three (3) different Instagram user accounts in the comment section of the George’s Deli and Coastal Buys Competition Post published via a “collaboration post” on the Coastal Buys Magazine, George’s Deli and Coastal Buys Australia Instagram pages.
(b) Once the Eligible Entrant has submitted an entry in accordance with clause 5(a), the entry will be taken to have been officially accepted by Alice & Co as a valid entry. Once an entry has been accepted, no changes to or withdrawal of the entry will be permitted.

6 DRAW
(a) The Competition will be run for the Competition Period, and a draw will be run on or after the End Date but before 23 December 2024, where via completely random means, three of the Eligible Entrants will be selected as the winners (Winners).
(b) There is only one draw and three Winners in the Competition.

7 PRIZE
(a) The prize that will be given to each Winner is a gift voucher to George’s Deli Kingscliff valued at $100 (Prize).
(b) If applicable, the value of any Prize is in Australian Dollars.
(c) All taxes and local government fees (excluding GST) that may be payable as a consequence of receiving the Prize are the sole responsibility of the Winner.
(d) Alice & Co is not liable for any loss or damage (even if caused by negligence) as a result of any winner accepting and/or using the Prize, except for any liability which cannot be excluded by law.
(e) Eligible Entrants acknowledge that Alice & Co makes no promise or guarantee regarding the suitability of the Prize. If the Winner has an issue or complaint with any organisation associated with the Prize, Alice & Co is not responsible for resolving the issue (though they may choose to do so).
(f) The $100 voucher must be spent in one transaction on food and/or drink purchases at George’s Deli Kingscliff. It cannot be used for more than one visit. 

8 ANNOUNCEMENT OF WINNERS
(a) Alice & Co will announce the Winner of the Prize on social media channels, including Coastal Buys Magazine and Coastal Buys Australia Instagram pages, as well as George’s Deli Kingscliff Instagram.
(b) The Winner will also be notified by way of direct message to their social media account (Notification) by an employee of Alice & Co who is responsible for the draw by 23 December 2024.
(c) Once notified, the Winner must provide Alice & Co with the following details:
(i) full name;
(ii) contact number; and
(iii) postal address.
(d) Alice & Co will post the Prize via registered mail to the Winner’s Postal Address within 5 days of receiving confirmation of the details in clause 8(c) or arrangements can be made with the approval of Alice & Co for another means of prize collection, for example directly from the restaurant (if approved).
(e) In the event that any part of the Prize becomes unavailable for reasons beyond Alice & Co’s control, Alice & Co may, at its absolute discretion, substitute the Prize (or the relevant part of the Prize) with a prize of equal or greater value.
(f) The Prize is not redeemable for cash or credit under any circumstances.

9 UNCLAIMED PRIZES
(a) Alice & Co will use its best endeavours to contact the Winner of the Prize using the contact details provided in the Winner’s Competition entry. However, Alice & Co will not be liable for the Winners’ failure to receive a Notification of winning if they provided incorrect contact details, their security settings caused the Notification to enter the spam, junk or ‘message requests’ folder, or if they have not updated their domain or email subscription to receive the Notification.
(b) If the Winners fail to comply with the instructions in a written Notification on claiming the Prize, the Winner’s entry will be disqualified, and they will not be entitled to the applicable Prize.
(c) Winners will have 7 business days to respond to the Notification with a message outlining the details in clause 8(c) otherwise they will forfeit the Prize.

10 USE OF ELIGIBLE ENTRANTS’ PERSONAL INFORMATION
(a) Personal information including Eligible Entrants’ names, addresses, telephone numbers, social media account details and emails, will be collected and used for the purpose of conducting this Competition. This may require disclosure to third parties, including local regulatory authorities and Alice & Co’s agents or third-party service providers for the purposes of conducting the Competition or for promotional and marketing purposes, including on social media (Purpose).
(b) By entering this Competition, the Eligible Entrants consent to the use of their personal information for the Purpose, and that Alice & Co may contact them for future marketing purposes without payment.
(c) Alice & Co may request the Winners to participate in publicity, photography and any other promotional activity as Alice & Co reasonably require without any compensation.
(d) Eligible Entrants may access, change and/or update their personal information by emailing Alice & Co at hello@aliceandco.com.au. A copy of Alice & Co’s privacy policy is available here Privacy Policy. The privacy policy contains information about how individuals may access or correct personal information or make a privacy related complaint.

11 GENERAL CONDITIONS
(a) Alice & Co accepts no responsibility for late, lost or misdirected entries or other communications.
(b) Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant’s responsibility to notify Alice & Co. An Eligible Entrant should direct any request to access or modify any information provided as part of the redemption of a prize to Alice & Co.(c) Alice & Co may at their absolute discretion request verification of any personal information of Eligible Entrants provided for the purposes of the Competition and arranging a prize.
(d) Alice & Co reserves the right to disqualify any individual who breaches these terms and conditions, or who is involved in any way in interfering or tampering with the fair and proper conduct of this Competition. Failure by Alice & Co to enforce any of its rights does not constitute a waiver of those rights.
(e) By entering this Competition, Eligible Entrants acknowledge and agree that these terms and conditions, the Competition and the consequences of receiving a prize may be subject to the terms and conditions of third-party service providers such as social media platforms, video platforms, payment providers and transfer companies (Third Party Terms). Alice & Co will not be liable for any damage or loss suffered by the Eligible Entrants in connection with such Third Party Terms. 
(f) Participants in the Competition may have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by Alice & Co. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the maximum extent that it is permitted to do so by law, Alice & Co (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, incidental, special or consequential, arising in any way out of the Competition, including, without limitation:
(i) any theft, unauthorised access or third party interference;
(ii) any entry that is late, lost, altered, damaged or misdirected (whether or not after the receipt by Alice & Co) due to any reason beyond the reasonable control of Alice & Co;
(iii) any variation in market value of the Prize to that stated in these terms and conditions;
(iv) any tax implications; and/or
(v) the Prize or any use of the Prize.
(g) Eligible Entrants and winners of the Competition agree at all times to indemnify and hold harmless Alice & Co and its officers, employees and agents (those indemnified) from and against any loss (including reasonable legal costs) or liability incurred or suffered by any of those indemnified where such loss or liability was caused by the Eligible Entrants and/or winners or their officers’, employees’ or agents’:
(i) breach of any term of these terms and conditions; or
(ii) negligent, fraudulent or criminal act or omission.
(h) Alice & Co will not be liable for performance delays nor for non-performance due to causes beyond their reasonable control. If the Competition is not capable of running as planned, Alice & Co reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, or amend these terms and conditions, unless to do so would be prohibited by law.
(i)These terms and conditions are governed by the laws applying in New South Wales, Australia.
